Welcome to DustyLinen.com (the “Site”), operated by MB Linorita (“we,” “us,” “our”). By accessing or using our Site and services, you agree to these Terms of Service (“Terms”). If you do not agree, you may not use our Site or services. These Terms apply to all users, including browsers, customers, merchants, and contributors of content.
These Terms incorporate by reference our Shipping Policy, Return & Refund Policy, and Privacy Policy (together, our “Policies”). If there is any conflict between these Terms and a Policy regarding a specific topic, the relevant Policy will control.
1) General Conditions
You confirm that you are at least the legal age of majority in your place of residence, or you have parental/guardian consent to use this Site.
You agree not to use our products or services for any unlawful purpose or to violate any applicable laws in your jurisdiction.
You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site, our services, or content without our express written permission.
We reserve the right to refuse service, cancel orders, or limit quantities for any lawful reason, including suspected fraud, misuse, or policy violations.
2) Your Account
If you create an account, you agree to:

notify us immediately of unauthorized access or suspected misuse.
3) Product Information & Made-to-Order Nature
Most Dusty Linen products are made to order. This means items are produced after purchase and may be tailored to selected options (fabric, color, finish).
We strive to display product information accurately, but we do not guarantee that descriptions, photos, measurements, availability, or other content are error-free.
Natural materials (including linen) may show normal variations in weave, texture, and shade. Colors may appear different depending on lighting and device screens. Such variations are not considered defects.
4) Pricing & Availability
Prices are displayed in EUR (€) or USD ($) depending on checkout settings and region.
Prices, promotions, and product availability may change without notice.
In the event of an obvious pricing or listing error, we may cancel the order and issue a full refund (and we are not obliged to provide the item at the incorrect price).
Discount codes:

may not be combined unless explicitly stated;

cannot be applied retroactively after an order is placed;
-
have no cash value and may be modified or discontinued at any time.
If you cancel an order within the allowed cancellation window, you will be refunded the amount actually paid. Re-issuing a discount code is at our discretion unless required by law.
5) Orders & Acceptance
Your order is an offer to purchase. We may accept or reject the order at our discretion.
Orders are typically confirmed by email after payment is successfully processed.
We may cancel or refuse an order if, for example:

an item or fabric becomes unavailable;

payment fails or is flagged as high-risk/fraudulent;
-
we cannot ship to the provided address or region; or
-
the order violates these Terms or our Policies.
If we cancel an order before dispatch, we will refund any payment received for that order.
6) Order Cancellations (12 Hours)
Because items are made to order, cancellations are time-limited:

Orders may be canceled within 12 hours of purchase.

After 12 hours, fabric cutting and production may begin and the order cannot be canceled.

Once an order is dispatched, cancellations are no longer possible.

7) Shipping: Destinations, Timing, and Responsibility
Our shipping terms are governed by our Shipping Policy, including shipping rates, free shipping thresholds, estimated delivery times, remote area surcharges, weight limits, and customs handling.
Where we ship:
We currently ship to the European Union (EU), the United States, Canada, Australia, and other selected destinations shown at checkout (if available).
Important: We do not ship to all states, provinces, or territories within these countries. Availability may be limited due to courier restrictions and destination-based surcharges (remote or extended areas). The most accurate list of available destinations is always the one shown at checkout.
We do not ship to the United Kingdom (UK) or China. If a UK or China address is entered at checkout, we may cancel and refund the order.
Processing time:
Orders are made to order. Processing typically takes 3–10 business days, depending on fabric availability, order volume, and seasonal workload.
Delivery estimates:
Delivery times shown are estimates and begin after dispatch. Delays may occur due to customs checks, severe weather, holidays/weekends, remote locations, or courier issues outside our control.
Remote area surcharges, destination-based fees, and weight limits:
Some addresses are classified by carriers (e.g., DHL) as remote or surcharge zones. Shipping prices shown at checkout are generally based on standard destinations and parcels up to 10 kg (as set out in the Shipping Policy).
If shipping costs increase significantly due to destination/location or exceeded parcel weight (over 10 kg), or if any destination-based surcharge applies and was not calculated at checkout, we will contact you before dispatch with the additional amount.
Orders are dispatched only after any required surcharge is approved and paid.
8) Customs, Duties, and Import Taxes (Non-EU Orders)
For deliveries outside the EU (including USA, Canada, Australia), you may be charged customs duties, import VAT/GST, and brokerage/clearance fees by local authorities or carriers.
These charges are:

not included in product or shipping prices unless stated;
-
not collected by us at checkout;
-
determined by local customs/couriers; and
-
the buyer’s responsibility.
Orders cannot be canceled, refunded, or returned solely due to unexpected customs charges or customs delays.
9) Unpaid Import Charges / Refused Delivery (Non-EU Orders)
If the recipient refuses to pay required import charges and the parcel is returned, abandoned, or destroyed by the carrier/customs, we apply the rules described in our Shipping Policy. In such cases, refunds and re-shipments (if possible) are handled according to that Policy.
10) Returns & Refunds
Returns and refunds are governed by our Return & Refund Policy, including:

custom-made/personalized items (generally non-returnable);
-
EU 14-day return rights for eligible standard items;
-
exclusions for hygiene-related goods if unsealed/used (where applicable);
-
the process for damaged/incorrect items; and
-
refund processing timelines.
11) Digital Gift Cards (If Offered)
If we sell Digital Gift Cards, the following terms apply:

Digital format only: Gift Cards are delivered electronically.

Validity: Gift Cards are valid for 12 months from the date of purchase unless a longer validity period is required by applicable law, in which case the legally required period applies.

Redemption: Gift Cards may be used for purchases on DustyLinen.com, including made-to-order items, subject to availability.

Balance: Any remaining balance stays on the Gift Card until used or expiry. If the purchase total exceeds the balance, the buyer pays the difference.

Non-refundable / no cash value: Gift Cards are non-refundable and cannot be exchanged for cash, except where required by law.

Risk of loss: You are responsible for safeguarding the Gift Card code. We are not responsible for lost, stolen, or unauthorized use of Gift Cards, except where required by law.

Taxes & duties: Import duties/taxes may apply to orders paid with Gift Cards; such charges remain the buyer’s responsibility.
12) User Content (Reviews, Comments, Photos)
If you submit reviews, comments, or other content:

you confirm you have the right to post it and it does not violate any third-party rights;

you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content for our business purposes (e.g., website, marketing), unless prohibited by law;

we may remove content that we consider unlawful, abusive, misleading, or inappropriate.
13) Intellectual Property
All content on this Site (including text, product photos, graphics, logos, designs, and layout) is owned by MB Linorita or used under license and is protected by applicable intellectual property laws. You may not use our content without prior written permission.
14) Prohibited Conduct
You may not:

use the Site for illegal purposes;

upload or transmit malicious code (viruses, malware);

attempt to gain unauthorized access to our systems;

engage in spam, phishing, scraping, or fraudulent activity;

We may restrict or terminate access for violations.
15) Third-Party Services & Links
The Site may use third-party services (payment processors, shipping carriers, analytics) or include links to third-party websites. We are not responsible for third-party content, policies, or services. Your use of third-party services may be subject to their own terms.
16) Limitation of Liability
To the maximum extent permitted by law:

We are not liable for indirect, incidental, special, or consequential damages (including lost profits, loss of data, business interruption) arising from your use of the Site or products.

We are not responsible for delays or losses caused by events outside our reasonable control (e.g., customs delays, courier disruptions, severe weather, strikes).

Our total liability for any claim related to an order is limited to the amount you paid for the product(s) in that order, except where liability cannot be limited under applicable law.
Nothing in these Terms excludes or limits rights and remedies that cannot be excluded under applicable consumer protection laws.
17) Indemnification
You agree to indemnify and hold MB Linorita harmless from any claims, losses, liabilities, and expenses (including legal fees) arising out of your breach of these Terms, misuse of the Site, or violation of any law or third-party rights.
18) Governing Law & Disputes
These Terms are governed by the laws of Lithuania. However, nothing in these Terms limits any mandatory consumer protections that may apply in your country of residence.
Where permitted by law, disputes shall be resolved in the competent courts of Lithuania. Consumers may also have the right to bring claims in their local jurisdiction where mandatory rules apply.
19) Changes to These Terms
We may update these Terms by posting a revised version on this page and updating the Effective Date. Your continued use of the Site after changes means you accept the updated Terms.
